Recommending the Nomination of the Japanese people who conserve war-renouncing Article 9 of the Japanese constitution for the Nobel Peace Prize 2016

We nominate “the Japanese people who conserve war-renouncing Article 9” for the Nobel Peace Prize, firmly believing that they will contribute to restraining state power, repealing the unconstitutional security laws, and realising a peace which does not rely on military force, based on the foundations of the constitution.

The Constitution of Japan is the only constitution globally which renounces war and the maintenance of armed forces and denies the right of belligerency of the state, while also recognizing the right to live in peace for all peoples of the world.* Japan has been a peaceful nation for the past 70 years, based on the foundations of this Constitution.

However, on July 1, 2014 the Cabinet made the decision to allow the use of the right to collective self-defence which had been prohibited until now, and on September 19, 2015 forced through a series of security related bills based upon this Cabinet decision which open the way for Japan to be involved in wars. These laws go against the pacifist preamble of the Constitution and Article 9 which is its concrete manifestation, and is invalid according to Article 98 of the Constitution. Furthermore, it is a change to the scope of the Constitution without following the procedures by the Japanese people outlined in Article 96 of the Constitution, thus invalid.

In summer of 2015, a fierce debate took place in both houses of the parliament, with all five major opposition parties in opposition to these moves. Constitutional scholars declared that the security bills are unconstitutional, and it became clear to the public that the contents of these bills were in fact a “war law.” Outside of the parliament, existing groups were joined by a diverse range of individuals and organisations including students, scholars and mothers, jointly raising their voices and standing up to be heard. Many of the Japanese people do not support the passing of these bills.

Although the constitution is facing a crisis, there has been no change to this highest of national laws, and each law which goes against the constitution is invalid. (Article 98 of the Constitution).

We strongly believe that “the Japanese people who conserve the war-renouncing Article 9” have it in their capacity to restrain the power of the state, repeal the unconstitutional security bills, and take back the three pillars of the constitution - respect for basic human rights, sovereignty of the people, and pacifism -  through nonviolent means such as public opinion, elections and legal appeals, based on the constitution. Furthermore, in this world suffering from so many conflicts, we nominate the Japanese people for the Nobel Peace Prize, as an encouragement to shine the war-renouncing Article 9 throughout the world and contribute to realising a peace which does not rely on military force.
